When a defendant
is accused of not complying with one or more of
the probation requirements from the negotiated
plea, or sentence imposed following a
trial the supervision or probation the
prosecuting authority choose to present a
Petition to Revoke thereby resulting in the
defendant being re-sentenced to a more severe
penalty.
There are various of reasons which an Ohio
or Michigan Probation Officer may accuse you of violating
your probation. Whether you are accused of
breaking a "technical" term or condition,
violating your probation by committing a new
crime,
Dennis Strong Law
may be able to assist you in representing your
legal interests for violation of probation
charges.
"Technical" violations of probation may include
the the act of changing your residence prior to
obtaining the appropriate approval, failing to
pay fines or restitution, or failing to report
for regularly scheduled visits with your
probation officer or for counseling. A
"technical" violation is typically not
considered a serious violation, and may be
subject to lighter punishment by the court and
your probation officer may choose to give you a
warning instead of filing an arrest warrant.
If the court issues a warrant, the sheriffs
office is directed to execute the warrant by arresting the
defendant.
Dennis Strong Law
can represent your legal interests in various
ways when you are accused of a probation violation.
When there is a
bond, we may help arrange your surrender to the jail. And when there
is no bond, we may assist in arranging your surrender to the court,
and ask the court to set a bond for your release. We may also be
able to make arrangements to ensure law enforcement does not
actively seek you on the warrant, once you have made a commitment to
surrender.
